All items offered for sale will be on display and will be available to be viewed at the Van Buren Police Department, Monday thru Friday: 8:30am to 4:30pm. CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 17 - 2014 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE PROVIDING MINIMUM ENERGY STANDARDS FOR THE DESIGN OF NEW BUILDINGS AND STRUCTURES OR PORTIONS AND ADDITIONS TO EXISTING BUILDINGS THAT PROVIDE FACILITIES OR SHELTER FOR PUBLIC ASSEMBLY, EDUCATION, BUSINESS, MERCANTILE, INSTITUTIONAL, STORAGE, AND RESIDENTIAL OCCUPANCIES, AS WELL AS THOSE PORTIONS OF FACTORY AND INDUSTRIAL OCCUPANCIES DESIGNED PRIMARILY FOR HUMAN OCCUPANCY BY REGULATING THEIR EXTERIOR ENVELOPES AND THE SELECTION OF THEIR HVAC, SERVICE WATER HEATING, ELECTRICAL DISTRIBUTION AND ILLUMINATING SYSTEMS AND EQUIPMENT FOR EFFECTIVE USE OF ENERGY; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, it has been determined by the City Council that there is an immediate need for adoption of the 2014 Arkansas Energy Code, which provides minimum energy standards for the design of new buildings and structures and additions to existing buildings; and WHEREAS, notice of a Public Hearing was duly published and a Public Hearing was conducted by the Van Buren Planning Commission; and WHEREAS, the proposed adoption was recommended by a majority vote of the entire Planning Commission. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, THAT: SECTION 1:There is hereby adopted by the City Council of the City of Van Buren, Arkansas, for the purpose of establishing rules and regulations for energy efficient standards for new building construction, this code known as the 2014 Arkansas Energy Code, being particularly the 2014 Arkansas Energy Code edition thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified, or amended, of which not less than one (1) copy of this ordinance, as well as, one (1) copy of the 2014 Arkansas Energy Code, will be on file in the office of the Clerk or Recorder of the City of Van Buren, Arkansas. SECTION 2: The same is hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this code shall take effect, the provisions thereof shall be controlling in the construction of all buildings and structures therein contained within the corporate limits of the City of Van Buren, Arkansas. SECTION 3: All Ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict. The various provisions and parts of this Ordinance are hereby declared to be severable, and, if any section or part of a section, or any provision or part of a provision herein, is declared to be unconstitutional, inappropriate, or invalid by any court of competent jurisdiction, such holding shall not invalidate or affect the remainder of this Ordinance and to that extent the provisions hereto are declared to be severable. SECTION 4: It is of the utmost urgency that the City of Van Buren, Arkansas has an up-to-date Energy Code to protect its citizens. Therefore, an emergency is declared to exist and this Ordinance, being necessary for the preservation of the public peace, health and safety, shall be in full force and take effect immediately upon and after its passage. IN WITNESS WHEREOF, the City of Van Buren, Arkansas, by its City Council, did pass, approve, and adopt, by a vote of 6 for and 0 against, the foregoing Ordinance at its regular meeting held on the 17th of November 2014. WHEREAS, the City Council adopted the 2011 version of the National Electrical Code with Local Amendments pursuant to Ordinance No. 14-2011; and WHEREAS, a more current edition is available that would better serve the needs of the City of Van Buren; and WHEREAS, notice of a Public Hearing was duly published, and a Public Hearing was conducted by the Van Buren Planning Commission to consider these proposed amendments; and WHEREAS, the proposed changes herein were recommended by a majority vote of the entire Planning Commission. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, THAT: SECTION 1:There is hereby adopted by reference the 2014 National Electrical Code with local amendments.
